Sailcottages Terms and conditions (T&Cs)

1. Introduction

These are the terms and conditions that apply when you book any Sailcottage holiday accommodation either directly with us, or through a booking agency/platform. They are in addition to any booking agency/platform T&Cs that apply.

You will be asked to confirm your acceptance of these terms and conditions when you make a request for a booking through us, in addition to our “House Rules' ' that can be found on our website www.sailcottages.co.uk and within the hand book within your holiday accommodation.

We reserve the right to amend these terms and conditions at any time, however the terms and conditions at the time of your booking will apply.

2. Booking Sailcottage accommodation directly with us

You must be at least 18 years old to make a booking.

A 25% deposit of the holiday cost is payable at the time of booking, the balance to be paid in full sixty days before your arrival date. Bookings made less than sixty days before your arrival date must be paid in full. If the balance is not received by the due date, then you will be deemed to have cancelled your booking.

A contract between you and Sailcottages will come into existence when the deposit payment is received and a booking confirmation is issued by Sailcottages showing the confirmed holiday dates, this may be by post or email. This contract binds you & all the members of your party. Please check the details carefully when you have received the booking confirmation and advise us of any errors.

It is your responsibility to ensure that all members of your party accept the terms of the contract set out in these terms & conditions of booking. Failure to disclose all relevant information or comply with these terms may lead to termination of the contract & loss of the booking. For clarity this booking is a short term Holiday let and is not an Assured Shorthold Tenancy agreement. Under no circumstances can Sailcottage accommodation be re-let or sublet, or used for any business purpose even free of charge, further you confirm that you will not under any circumstances use any sailcottages property as your sole or main residence.

The Sailcottages team or our representatives reserve the right to enter the property at any time to undertake essential maintenance, routine inspections and servicing needed to comply with relevant legislation/ regulations or for inspection purposes. We will endeavour to give you as much notice of this as possible.

To allow us to comply with “The Immigration (Hotel Records) Order 1972” if you book directly through us, we are required to obtain your full name, address and nationality. Further if you or any of your party are not UK citizens then we are also required to obtain from you the number and place of issue of each passport of those guests not a UK citizen. Before departure you are required to inform us of your next destination and if known, your full address. Please email the details of your next destination to us at nextaddress@sailcottages.co.uk Please note that we are required by the 1972 Order to hold this information for 12 months from the time of your departure, at which time we will delete this information.

3. Pricing

Our holiday accommodation prices vary depending upon demand, Sailcottages are not registered for VAT.

A welcome pack is provided with basics that will include milk, tea, coffee, sugar, washing up liquid, dishcloth. Linens and towels are also provided (bath towel, hand towel, face cloth, bedding).

Sailcottages are self catering holiday accommodation and meals are not included.

4. Occupancy

The maximum number of persons occupying the property must not exceed (2 persons) Skysail or Moonsail and only those listed on the booking form can occupy the property.

No additional overnight visitors are permitted, and you must not exceed the maximum occupancy for the booking.

Occupancy is not transferable. We reserve the right to request valid photographic proof of identity.

Skysail and MoonSailcottages are not suitable for infants, young children or people with mobility issues. The lead guest is responsible for the safety and security of anyone under 18 at all times. Under 18’s must be accompanied by a parent or guardian under your booking.

Skysail cottage is only located on the ground floor so it may be suitable for guests with limited mobility, please contact us a minimum of 14 days before you arrive to discuss this so we can advise if the accommodation is suitable for you.

Your stay

Check in time 4pm

Check out time 10am

Please park your vehicles in the designated parking space, ensuring cars do not block access to other properties. Parking on the front drive is limited to 1 vehicle per cottage. An EV charging unit is available for use at the front of the property

Electricity and Gas fair use agreement

Sailcottages include all utilities in your charges, however in order to keep charges to our guests as low as we can, the following fair usage policy will apply for energy usage during your stay with us. This is to ensure that your energy usage is not excessive and stays within reasonable allowances. The allowances are generous and you are unlikely to exceed these limits if you are sensible with your energy usage. These figures will be calculated and adjusted accordingly for the length of stay.

If you exceed these limits, Sailcottages reserve the right to apply a supplemental charge to cover the amount by which you exceeded the allowances. Sailcottages also reserves the right to charge additional administration fees and late payment fees as per our terms and conditions.

Anything above 150 kWh for Gas and 75 kWh for electricity per week would be classed as excessive:

6. Our expectations of you and your guests

Please treat the facilities & accommodation with due care and attention so that other guests may continue to enjoy them. If you notice something is missing or damaged in your accommodation, please let us know immediately so that we can take the appropriate action. If there has been any damage or breakages during your stay, please inform us promptly, and before check-out. The accommodation will be inspected at the end of the holiday & you may be charged for any loss or damage.

We request that you:

Do not move any furniture from one room to another

Please remove shoes before entering the house

Ensure doors are locked and windows are closed before leaving the property

Switch off lights, any electrical appliances, and turn the heating down when you leave the property

Do not remove bath towels or hand towels from the property

Please respect our community and try to keep noise levels to a minimum, especially between 10:30 pm and 8 am. We reserve the right to terminate a holiday without compensation where the unreasonable behaviour of the persons named on the booking (or their guests) may impair the enjoyment, comfort or health of others.

The following is not permitted

The use of products that may stain the towels or linens, this will include (but is not exclusive to) hair dye, self tanning lotion

Sleeping in the loft room of Moonsail (fire regulations)

Unless advised in the property description Pets, with the exception of licenced assistance dogs (please advise in advance)

Parties and/or social events held at the property

The use of candles or other naked flames within the property (except the woodburner in SkySailcottage)

Charging of any battery, or device from within the property with a capacity greater than 1 kwh, this will include (but is not exclusive to) ebike batteries etc, charging of electric vehicles - a dedicated Monta managed EV charging point is located at the front of Skysail cottage and this is the only permitted way to charge an EV.

The use of any electrical appliances not provided by Sailcottages that may set off the fire alarm system, such as toasters, mini cookers, portable grills, coffee machines, air or deep fat fryers, air conditioning units, electric fans, electric fires.

Smoking, vaping

Bikes, Ebikes, Escooters within the property - a bike store is available for use (Skysail back of property, Moonsail front of property)

Bring any potentially dangerous or hazardous materials or equipment onto Sailcottage premises

Tamper with any fire alarms, boiler, electrical,Internet, heating system including controls or emergency equipment.

Store any potentially hazardous items within the property

Engage in any unlawful activity during your stay e.g. taking an illegal substance

COVID-19 (also referred to as Coronavirus):

you must immediately notify us to the extent you or anyone staying with you (or on your reservation) is (i) self isolating or (ii) should be self isolating pursuant to Government guidelines. In any event, Sailcottages reserves the right to cancel any reservations (before or during the stay) to the extent it is for self isolation.

If the property allows dogs then The following dog terms apply: 

  • Dogs must be under strict control at all times while in or at the Property;

  • Any fouling must be cleared up without delay;

  • The dog owner must bring the dog's bed or basket for sleeping in;

  • Dogs must not be left alone in or at the Property or elsewhere at any time;

  • Dogs must remain downstairs at all times, not lie on beds or furnishings, and hair must be cleared up before departing; 

  • Dog owners must ensure that their pets are free from parasites and fleas before they occupy the Property. Failure to do so may incur subsequent charges; 

  • Young dogs (e.g. puppies less than 6 months’ old) must be declared to us at the time of booking and authorised by the Owner; 

  • You will be liable for any damage caused by any Holidaymakers’ dogs. Any damage is to be reported to the Owner (or their representative) immediately. Any additional cleaning required, that may incur an additional charge, will be at the Owner's discretion. 

Pets other than dogs may be allowed at the Owner’s discretion. This must be approved in writing prior to making a booking.

If you break these terms, the Owner (including their representative) or we may notify you that you have broken these terms and may cancel the booking and ask that the Holidaymakers leave the Property before the end of the holiday period without compensation, or that they pay an additional reasonable charge.Sailcottages are not responsible for the loss of any personal belongings or valuables of the guest.

If you or any member of your group cause damage or loss of any kind to Sailcottage property, you (as the person making the booking) will be responsible for that damage or loss and you shall be liable to pay to Sailcottages on demand the amount required to make good or remedy such damage or loss. For the avoidance of doubt, if Sailcottages requests that you or any member of your group are to leave the property following a breach of these terms and conditions, you will also be liable to pay Sailcottages on demand all costs associated with such removal.

If you or a member of your group cause damage to the Sailcottage properties or equipment, or otherwise breach any of these terms and conditions, we reserves the right to:

Cancel your booking with immediate effect and (if appropriate) eject you from Sailcottage premises

Cancel door codes and restrict access to the property

Remove your items from the property, disposing of such items (at no cost and no liability) to a local charity to the extent such items are not collected from us within 7 days of removal

Retain all sums paid by you and/or charge you the full amount of your reservation; and/or

Refuse future reservations from you and/or refuse you entry or accommodation at any of our properties.

Sailcottages will not be liable for any refund or compensation in such circumstances.

Sailcottages reserves the right to decline or cancel reservations made and stays in progress by those who have previously breached these terms and conditions (as may be updated from time to time), whether the reservation is in that name or not.

7. Cancellation

For bookings made directly with us:

If you are required to cancel your booking, please notify us in writing and we will confirm the cancellation within 72 hours of receipt. The customer remains liable for a percentage of the booking cost when a cancellation is received, as detailed below:

30 - 44 days. 50% of the booking cost

15 - 29 days. 75% of the booking cost

3 - 14 days. 90% of the booking cost

0 - 2 days. 100% of the booking cost

8. Our right to cancel

We may cancel your booking at any time with immediate effect by giving you written notice, this will include email if:

you do not pay us when you are required to do so; or

you breach the contract between us in any way; or

you have previously breached the contract between us in any way.

If we cancel your reservation where you are at fault, we reserve our legal rights in respect of your breach of contract. Where your stay has or had not yet commenced, the total payment made or to be made by you for the booking shall be deemed a cancellation charge and is not for any service.

If we need to cancel:

We may cancel your reservation if an event outside of our reasonable control (including outbreak of disease, flooding, fire, power or water supply failure, industrial action, explosion, issues relating to health and safety or emergency evacuation) means that we are unable to make your accommodation available to you and your guests. In this case we will contact you to let you know as soon as possible. We will refund any payments received by us for the holiday cottage booking (deposit or when applicable, full payment if received).

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations that are caused by an event outside of our control. This does not affect your statutory rights.

Our liability for cancellation will be limited to payments made to us.

We strongly advise that you take out comprehensive travel insurance to cover cancellations. If you choose not to, then you accept responsibility for any loss that you may incur due to your cancellation.

9. Complaints

You must tell us (or our representative) as soon as possible if there is a problem and you are dissatisfied. This means on arrival if you are immediately dissatisfied or during your stay as soon as you become dissatisfied, or within 7 days of your departure. You must provide an immediate opportunity for the Sailcottages to put right anything that is wrong before the end of your stay. You must make every reasonable attempt to contact us during your stay and especially before any decision to cut short your stay.

If we know about a problem before you arrive, we will contact you to let you know. We cannot be held responsible for the breakdown of mechanical equipment such as pumps, boilers, nor for the failure of public utilities such as water, gas, broadband or electricity, none of these shall constitute a breach of our booking contract.

If we are found to be at fault in relation to any service we provide, we will not pay more than we have earned for the booking (or the appropriate proportion of this if not everyone on the booking is affected or if the problem does not impact your entire stay).

If you did not raise your complaint during your stay, or were unable to do so, you must contact us directly through our web form or by email to complaints@sailcottages.co.uk within 48hrs of your check out . If your accommodation was booked as part of a group booking, the person who made the booking on behalf of the group must make the complaint.

If you feel that a problem you have raised has not been dealt with to your satisfaction, you must, within 28 days of your check out date, put your complaint in writing to us.

Sailcottages shall not be liable for any temporary defect or malfunction of any equipment, Internet WIFI, machinery or appliance in the building or grounds. No compensation will be given for any temporary outage of electricity, gas, water, internet connection or television service.

Sailcottages cannot be held responsible for noise or disturbance which comes from beyond the boundaries of the accommodation or which is beyond Sailcottages control

By accepting these terms and conditions you warrant that all persons occupying the property are travelling either on business or on holiday, and that no Sailcottages property is being used as your sole or main residence. You further warrant that all persons occupying the property will read and follow the “house rules” House rules can be found in the user guide for your booked property which can be found in a folder in the property as well as on our Website www.sailcottages.co.uk and use the password "gurnard".
